1. Acceptance of Terms

By downloading, installing, or using Emoodjee (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App. Emoodjee is operated by Emoodjee (“we,” “us,” or “our”).

2. Description of Service

Emoodjee is an emoji-first, AI-powered micro mood journal available on iOS and Android. The App allows you to log daily mood entries using emoji and short text (up to 140 characters), receive AI-generated insights, and track emotional patterns over time.

Emoodjee is a self-awareness tool. It is not a medical device, therapy service, or clinical intervention. It does not provide diagnoses, treatment plans, or medical advice.

3. Eligibility

You must be at least 18 years old to create an account and use Emoodjee. By using the App, you represent that you meet this age requirement.

4. Your Account

You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at our support page if you suspect unauthorized access.

5. Free and Premium Tiers

Emoodjee offers a free tier and a premium subscription (“Emoodjee Pro”).

Free tier includes unlimited mood entries, immediate AI micro-responses, 7-day mood history, basic mood calendar, and cumulative check-in milestones.

Emoodjee Pro includes everything in the free tier plus AI weekly synthesis reports, unlimited mood history, biometric lock, and deeper AI responses. Pricing is displayed in the App and managed through the Apple App Store or Google Play Store.

The free tier is designed to be genuinely useful on its own — not a limited trial.

6. Subscriptions and Billing

Premium subscriptions are billed through the Apple App Store or Google Play Store. By subscribing, you agree to the billing terms of your respective app store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your device’s subscription settings or through the App.

7. Your Content

You retain full ownership of all content you create in Emoodjee, including your mood entries, sentences, and any exported data. We do not claim any intellectual property rights over your content.

By using the App, you grant us a limited license to process your content solely to provide the service — generating AI insights, detecting patterns, and delivering your personalized experience. This license ends when you delete your account.

8. AI-Generated Content

AI insights, weekly syntheses, and pattern observations are generated by artificial intelligence. While we strive for accuracy and relevance, AI-generated content may not always be correct or applicable to your situation. AI outputs are provided for self-reflection purposes only and should not be treated as professional advice.

Emoodjee does not use clinical language and is not designed to diagnose, treat, or manage any medical or mental health condition. If you are in crisis, please contact your local emergency services or a crisis helpline.

9. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract the source code of the App or its AI models
• Interfere with the App’s infrastructure or other users’ experience
• Create multiple accounts to abuse the free tier or circumvent restrictions
• Use the App to generate content that is harmful, abusive, or intended to harm others

10. Privacy

Your privacy is fundamental to Emoodjee. Our Privacy Policy describes how we collect, use, and protect your data. By using the App, you agree to the practices described in the Privacy Policy.

11. Data Deletion

You may delete your account and all associated data at any time through the App settings or by contacting us at our support page. Deletion is permanent and cannot be reversed. We will process deletion requests within 30 days.

12. Disclaimers

Emoodjee is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We are not responsible for decisions you make based on AI-generated content.

13. Limitation of Liability

To the maximum extent permitted by law, Emoodjee and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to emotional distress, loss of data, or loss of profits.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notification at least 14 days before they take effect. Continued use of the App after the effective date constitutes acceptance of the updated Terms.

15. Termination

You may stop using Emoodjee and delete your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the App ceases immediately. You may still request export or deletion of your data.
